These terms apply to the website. Academy enrollment, range participation, and training may require separate agreements, consents, and safety documents.
1. Acceptance of These Terms
These Terms of Service ("Terms") govern your access to and use of skyarcacademy.com and its forms, scheduling tools, content, and related online services (the "Site"). By using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.
2. Adults, Parents, and Guardians
You must be legally capable of agreeing to these Terms. Forms involving a youth athlete must be completed by a parent, legal guardian, or other adult authorized to provide the requested information and act for the athlete. You are responsible for the accuracy of the information you submit and for keeping trial reference codes secure.
3. Website Information
Site content is provided for general information about Sky Arc programs, schedules, tuition, training pathways, and academy operations. We work to keep it accurate, but programs, availability, instructors, eligibility standards, prices, and schedules may change. Website content is not a guaranteed offer, enrollment confirmation, professional advice, or substitute for direct written confirmation from Sky Arc.
4. Trial and Scheduling Requests
- A submitted request does not guarantee a reservation, enrollment, placement, or particular session.
- Trial One completion and the matching reference record may be required before Trial Two can be requested or confirmed.
- Sky Arc may contact you to confirm, modify, reschedule, decline, or cancel a request based on capacity, safety, staffing, eligibility, or operational needs.
- You agree to provide current, complete information and promptly tell us if it changes.
5. Safety and Participation
Air-rifle training requires strict compliance with coach instructions, range commands, equipment rules, and academy policies. Sky Arc may restrict or end participation when reasonably necessary for safety or conduct. Use of this Site alone does not authorize range participation and does not replace any enrollment agreement, waiver, medical disclosure, consent, code of conduct, or other document required before training.
Nothing in these Terms waives rights or obligations that cannot lawfully be waived.
6. Communications
When you submit contact or scheduling information, you authorize Sky Arc to respond using the email address or phone number you provide about your inquiry, request, scheduling, safety, or academy services. Standard carrier charges may apply to phone communications. You may request to stop nonessential promotional communications, but we may still send service-related messages.
7. Acceptable Use
You may not:
- Use the Site unlawfully, fraudulently, or in a way that threatens safety or another person’s rights.
- Submit false information, impersonate another person, misuse another family’s reference code, or attempt unauthorized access.
- Probe, disrupt, overload, scrape, reverse engineer, or interfere with the Site or its security.
- Upload malicious code or use automated systems to extract content or submit requests without permission.
- Copy or exploit Site content except as allowed by law or written permission.
8. Intellectual Property
The Site and its text, graphics, photographs, logos, designs, program materials, and other content are owned by or licensed to Sky Arc and are protected by applicable intellectual-property laws. Sky Arc grants you a limited, revocable, nonexclusive, nontransferable right to use the Site for personal, noncommercial purposes. No other rights are granted.
9. Feedback and Submissions
You retain ownership of information you submit. You grant Sky Arc permission to use it as reasonably necessary to respond, administer services, protect the academy, and fulfill the purpose for which it was provided. If you voluntarily send ideas or feedback, we may use them without restriction or compensation, provided we continue to handle personal information as described in the Privacy Policy.
10. Third-Party Services
The Site may rely on or link to third-party hosting, email, translation, or other services. Their own terms and policies govern your direct use of those services. Sky Arc does not control and is not responsible for third-party content, availability, or practices.
11. Disclaimers
To the fullest extent permitted by law, the Site is provided "as is" and "as available." Sky Arc disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant that the Site will always be uninterrupted, error-free, secure, or free of harmful components, or that information will always be complete or current. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.
12. Limitation of Liability
To the fullest extent permitted by law, Sky Arc and its owners, coaches, staff, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or use, arising from or related to the Site. Where liability cannot be excluded, aggregate liability arising from use of the Site will not exceed the greater of amounts you paid specifically for the online service giving rise to the claim or one hundred U.S. dollars. This limitation does not apply where prohibited by law and does not modify liability governed by a separate signed academy agreement.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Sky Arc and its owners, staff, coaches, contractors, and service providers from claims, losses, liabilities, and reasonable costs arising from your unlawful misuse of the Site, your material breach of these Terms, or information you submit without proper authority. This obligation does not apply to the extent a claim results from Sky Arc’s own unlawful conduct.
14. Suspension and Termination
We may suspend, restrict, or terminate access to the Site when reasonably necessary to protect users, security, safety, legal compliance, or academy operations. Provisions that by their nature should survive termination—including intellectual property, disclaimers, liability limits, indemnification, and dispute provisions—will survive.
15. Governing Law and Disputes
These Terms are governed by the laws applicable in the jurisdiction where Sky Arc Sports Academy is established, without regard to conflict-of-law principles, except where consumer-protection law requires otherwise. Before filing a formal claim, you and Sky Arc agree to make a good-faith effort to resolve the issue by written notice. Any unresolved dispute may be brought in a court of competent jurisdiction, subject to applicable law.
16. General Terms
If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Sky Arc may assign them in connection with a reorganization or transfer of the academy. These Terms, together with the Privacy Policy and any applicable signed agreement, form the relevant agreement about Site use.
17. Changes to These Terms
We may revise these Terms when our Site, services, or legal obligations change. Updated Terms will be posted here with a new effective date. Continued use after an update means you accept the revised Terms to the extent permitted by law.
